Hill Tracts Region    Judiciary System in CHT 

Since the British period, the Judiciary System in CHT is different as well as exceptional from that of the rest of the country. The Chittagong Hill Tracts Regulation, 1900 is the fundamental component of the Judiciary System of CHT. According to the CHT Regulation, 1900 there is no separate Civil Court in CHT. In addition to his criminal jurisdiction the Deputy Commissioner acts as the Civil Court which is equivalent to the Joint District Judge. The Deputy Commissioner is empowered to revise any judiciary order of the district under his/her jurisdiction. The appealing authority is the Divisional Commissioner, Chittagong Division. He acts also as Ex-Officio Session Judge of the CHT region.

 

In the Chittagong Hill Tracts, the traditional courts also prevail side by side with the as usual courts of the country. The Hill people usually still follow the traditional justice system and go to Raja Court (Circle Chief) for all petty cases involving tribal matters custom, usages and traditions such as marriage, divorce, adoption and inheritance and so on. The Headman or the Karbari also deals the criminal cases under his/her jurisdiction.
